Terms of Service.

These Terms of Service ("Terms") govern your use of AfriBeats, accessible on the web at afribeats.co.za (the "Service"), operated from South Africa. By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. The service

AfriBeats lets you generate AI-made music tracks from text prompts, delivered in the web app. Generation is powered by third-party AI infrastructure (Graydient). Each generation consumes one or more "credits" from your account balance.

2. Accounts

• You must provide accurate information when creating an account and keep your password secure. You're responsible for activity that happens under your account.
• You must be at least 18 years old to use AfriBeats.
• One person may not operate multiple accounts to obtain additional free trial credits.
• We may suspend or terminate accounts that violate these Terms, abuse the Service, or engage in fraudulent activity (e.g. chargebacks, fake referrals).

3. Credits & payment

• New accounts receive a number of free trial credits as stated at signup.
• Additional credits may be purchased through supported payment methods. Prices are shown at the time of purchase and may change for future purchases.
• Credits are deducted when a generation is submitted. Generations are processed one after another in a queue, so when demand is high your song may wait, and we may temporarily stop accepting new requests. A request we decline is never charged. If a generation fails due to an error on our side or our AI provider's side, the credit is refunded to your account.
• Credits are non-refundable for cash once purchased, except where required by applicable consumer protection law, or where AfriBeats is unable to deliver the Service for an extended period.
• Credits have no cash value, cannot be transferred between accounts, and may expire if your account is deleted or terminated.

4. Acceptable use

You agree not to use AfriBeats to generate or distribute content that:

• Infringes someone else's copyright, trademark, or other intellectual property rights;
• Is hateful, harassing, defamatory, obscene, or promotes violence;
• Impersonates a real person or organisation without consent;
• Is used for spam, scams, or any unlawful purpose.

We reserve the right to remove generated content, refuse generation requests, and suspend accounts that violate this section.

5. Your content & ownership

• You retain ownership of the prompts and lyrics you write.
• Subject to your compliance with these Terms, you may use the audio tracks generated for you (including commercially), for example as Thembi did for her mom's 60th.
• You're responsible for ensuring that any names, lyrics, or styles you reference in a prompt don't infringe third-party rights. AfriBeats does not guarantee that generated output is free of unintentional similarity to existing works.
• AfriBeats and its AI providers retain rights to the underlying models and infrastructure used to generate your tracks.

6. Availability

We aim to keep AfriBeats available, but the Service depends on third-party providers (AI generation, hosting) and may experience downtime, delays, or interruptions outside our control. We don't guarantee uninterrupted access.

7. Limitation of liability

To the maximum extent permitted by law, AfriBeats and its operators are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including lost data, lost profits, or the unavailability of generated content. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim arose.

8. Termination

You may delete your account at any time from the Account tab in the app. We may suspend or terminate your access if you violate these Terms. On termination, your right to use the Service ends, and any remaining credits are forfeited (except where refundable by law).

9. Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you by email. Continued use of the Service after changes take effect means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.
